And Colin Scott Brown, of Boundary Crescent, also admitted that he refused to give a breath sample on August 12.

Police prosecutor Sgt. Phil Taylor told the court that Brown's car was seen by Police officers on Middle Road in Paget swerving across the centre line.

As a result, an accident involving another car and a motorcycle occurred.

Sgt. Taylor said the cycle rider noted Brown's licence plate number and followed him to the Belmont Hotel where he noticed his "unsteadiness, glazed eyes and intoxicated breath''.

The Police were called and they arrested Brown who was detained at the Hamilton Police Station where he refused to give breath samples.

But yesterday Brown's lawyer, Tim Marshall, asked Senior Magistrate Will Francis to be "merciful'' as the accident did not result in any physical injuries.

Mr. Marshall also said his client was "very remorseful''.

Mr. Francis fined Brown $400 and banned him from driving all motor vehicles for 12 months.
