Wor. Will Francis to pay $1,000 in mean profits to Mr. Froomkin's former landlord yesterday.

The landlord, Mr. David A.J.G. White of Smith's Parish, had taken Mr. Froomkin to court to recoup additional rent payments he said he could have collected had Mr. Froomkin vacated his property under previously agreed upon terms.

Now a partner at Mello, Hollis, Jones and Martin, Mr. Froomkin had leased a two-bedroom house on South Shore Road in Smith's from Mr. White from January 1991 to January 1994.

Under the terms of the lease, Mr. Froomkin was supposed to vacate the house at the end of that period. Since he did not move out until the end of last July, however, Mr. White sued him for $1,000 -- $250 for each of the four extra months Mr. Froomkin stayed on.

Mr. Froomkin's rental payments during his three-year tenancy were $2,750 a month. Mr. White has since leased the house for $3,000 a month.

Despite Mr. Froomkin's arguments that he had taken every reasonable step to vacate the premises by the specified date and had made a number of repairs and improvements to the house, Mr. Francis said yesterday that those acts did not necessarily entitle him to continue living on the property under the same terms as his lease.

"I therefore find that the plaintiff has suffered loss from this holding over and award to the plaintiff $1,000 with costs,'' he ruled.

Mr. Francis said the expert witness Mr. White had produced during the civil hearing was one of the factors that swayed him in his decision.

Realtor Mr. Thomas Moss had testified during the hearing that Mr. White's house could fetch "as much as'' $5,000 a month in rent.
