Judgment reserved in wrongful dismissal case
Corrine Swan who is suing her former employer Onions Bouchard & McCulloch (OBM) for wrongful dismissal.
Ms Swan was employed at the architectural firm for three months as an assistant accountant before being fired in 1995. She was given one month's pay in lieu of notice. She is claiming five months wages in damages.
Ms Swan's lawyer Marc Telemaque told the court the firm had expressed no dissatisfaction with Ms Swan's work up until the day she was fired. Instead, he alleged a rivalry had developed between Ms Swan and her supervisor Lynn Boys due to improvements Ms Swan had initiated at the firm.
Ms Boys then allegedly gave the board of directors an ultimatum that they fire Ms Swan or she would leave the firm instead, according to Mr. Telemaque.
OBM lawyer Juliana Jack claimed in its defence that Ms Swan had been on probation and the company was in its rights to let her go. Ms Jack said one month's salary in lieu of notice was therefore reasonable compensation.
Puisne Judge Vincent Meerabux reserved judgment on the case.
