Lawyers wrap up arguments in Hardell dispute
Lawyers wrapped up their arguments on Friday in a dispute between Hardell Entertainment Ltd. and the Ministry of Telecommunications over the issuance of a wireless cable licence and frequency allocation to World on Wireless!
While a licence and frequencies were granted to Hardell last week on court order, lawyers continued to argue a second issue in the legal dispute ? whether former minister Renee Webb could lawfully grant or issue a cable television service operating licence to WOW while she was facing legal proceedings on the issue.
The parties dispute whether the minister granted the licence before or after the injunction was served.
An unsigned licence has been presented into evidence, but there is no evidence to clarify the actual time when the minister made her decision and granted the licence.
The judge has noted that it was unlikely she granted the licence at the Press conference itself.
The lawyers are also concerned with the validity of the formal order served on the minister.
Solicitor General Wilhelm Bourne argued it goes beyond its jurisdiction because such orders can only apply to the proceedings of an inferior tribunal and not the decision making process of a minister.
Hardell lawyer Delroy Duncan presented a number of authorities that he said set precedent to make the document enforceable against the minister.
The judge will make his decision at an unspecified date.
