Biker who lashed out gets ban
A suspected drunk-driver who led Police on a chase through Warwick and then violently resisted arrest has been fined and banned from the roads.
Crown counsel Robert Welling told Magistrates' Court that Damien Swan, 22, sped past the Police on his Honda Scoopy bike in the early hours of June 6. His helmet was unfastened and his headlight was off.
The Police pursued him until he lost control of the cycle and fell to the ground. Swan, of Lusher Hill, Warwick, then took off on foot, according to the prosecutor. The Police caught up with him trying to climb a wooden fence on Tribe Road Number One.
When he lashed out at the officers, he had to be subdued with captor anti-assault spray. At this point, they noticed that he smelled of alcohol.
Mr. Welling reported Swan to have said: "I didn't pass no Police cars and I'm not drunk so f**k off."
He pleaded guilty to violently resisting arrest and failing to comply with a demand for a sample of breath, but denied riding while impaired. Mr. Welling offered no evidence on that charge.
Senior Magistrate Archibald Warner fined Swan $1,500, banned him from driving all vehicles for 12 months, and meted out ten demerit points.
