Maxwell Charles Joell of Cataract Hill, was pulled over by officers as he drove his motorcycle "at excessive speeds'' along St. John's Road in Pembroke on November 9.

Sgt. Peter Giles, prosecuting, said the officers noticed that Joell appeared to be intoxicated and smelled of alcohol. An alco-analyser test registered 139 milligrams of alcohol per 100 millilitres of blood.

Police also discovered Joell did not possess a valid driver's licence. The 44-year-old man said he did not feel drunk at the time, but Mr. Francis said the charge was for "impaired driving'', and regardless of how he felt he was breaking the law.

"If you are in charge of a vehicle -- whether it's moving or not -- and you have more than 80 milligrams (of alcohol) in your bloodstream, you will be arrested, and charged. And in my court, you will receive a minimum fine of $350 and a year off the road,'' said Mr. Francis.

Joell was fined $100 for driving without a licence. Sgt. Giles told the court there was no record of Joell ever having a licence.
