justice in the sexual assault case of British P.c. Andrew Robinson.

Robinson was found guilty earlier this week of housebreaking and sexual assault.

P.c. David Bird and P.c. Nicholas Sutton, both 27, investigated the complaints against Robinson last summer.

They were charged in Magistrates' Court in March with conspiring together to obstruct the course of justice and with "refusing to do an act which was their duty to do.'' They were not required to enter pleas because the first charge must be tried in Supreme Court. They were bailed in the sum of $2,500 each with like sureties.

The two officers have been suspended from the Police Force pending the outcome of the trial and ordered not to leave Bermuda except for two weeks each for travel to the UK for personal reasons.

Crown counsel Mr. Brian Calhoun said the Attorney-General had "farmed out'' the job of prosecuting the case to a private lawyer because of its "inherent conflict of interest.'' "We prosecuted Robinson, we can't also be prosecuting the witnesses,'' he said.

Lawyer Mr. Tim Marshall, who has the job of prosecuting, said yesterday a preliminary inquiry was set for the week of January 18, 1995.

Robinson, 28, was found guilty on Monday of breaking and entering and sexual assault on a woman on July 25, 1993. He had claimed he was invited over to the woman's house. But she said he broke into her home while she was fast asleep and sexually assaulted her.

Magistrate the Wor. Cheryl-Ann Mapp has adjourned sentencing until January 19, 1995 after a social inquiry report.
