No retrial in Durrant, Gardner conspiracy to murder case

Two men who walked free after a jury could not decide if they plotted to kill five witnesses will not face a retrial, the Court of Appeal has ruled.

Kenneth Durrant and Javon Gardner were cleared last November of attempting to pervert the course of justice. The jury was unable to agree on the other charges the pair faced, of conspiracy to kill people who happened to be likely witnesses in a separate court case involving Mr. Gardner.

Director of Public Prosecutions Vinette Graham Allan asked the Court of Appeal to consider whether Mr. Durrant and Mr. Gardner should be brought back to face another trial.

President Justice Edward Zacca said on Friday that the appeal had been dismissed, but did not give reasons for this.
