Test refusal results in lengthy disqualification

A Devonshire man has been banned from driving for 18 months after refusing to give a blood sample to police.

Yatindar Srinivasan Kayalvizhi pleaded guilty to refusing to comply with a demand made by a police officer to give a sample of blood for analysis on August 3, 2025.

The court heard how the 20-year-old was riding a motorcycle at about 8.15pm in Warwick when he lost control and ran off the road.

Emergency services attended the scene and police officers noticed a “strong” smell of alcohol on his breath.

Kayalvizhi was arrested but refused to consent to an analysis of blood, stating: “I’m not doing it.”

He was informed refusal was an offence but still said no.

On August 18, 2025, Kayalvizhi was charged with driving while impaired and refusal to give blood samples.

Magistrate Maria Sofianos said yesterday in court: “Parliament has been serious about their attitude and response to people that wilfully drive vehicles when they have consumed alcohol.”

Kayalvizhi was fined $1,500 fine and given an 18-month disqualification.
