right to store building materials at a lot in Ferry Reach, St. George's.

In 1991, the Development Applications Board refused Mr. Michael Bierman's bid to store imported aggregate at Lot B on Ferry Road on the grounds the land was zoned for light industrial development only.

Mr. Bierman appealed the decision to Environment Minister the Hon. Gerald Simons.

Mr. Bierman's lawyer Mr. Mark Ray argued his client's plans constituted light industry and submitted a scientific report to back up his claims.

But this month, conceding there had been an "excessive delay'' in hearing Mr.

Bierman's appeal, the Minister upheld the DAB's decision.

Mr. Ray confirmed yesterday his client has decided to appeal the decision to the Supreme Court.

He said the site, a small portion of some 28 acres of property Mr. Bierman owns, was an ideal location for the storage of aggregate. The material, used to make concrete block, is mostly off loaded at Penno's Wharf in St. George's after being shipped here, thus eliminating the need to cross the Swing Bridge which has load limits.
