Woman fined for refusing breath test

A 47-year-old Paget woman was banned from the road after refusing to take a breath test.Kelly Way admitted in Magistrates’ Court that she refused to give a breath sample when stopped by police while driving on September 10.Crown counsel Cindy Clarke said officers travelling West on East Broadway saw a white car headed in the same direction around 12.30am that day.The car repeatedly crossed the middle line and the officers noticed the driver braked erratically. The officers stopped the car.The court heard they smelled alcohol on Way’s breath and noticed her eyes appeared glazed.She was arrested on suspicion of impaired driving but refused to take a breath test at Hamilton Police Station.Way apologised for the incident in court.Senior Magistrate Archibald Warner fined her $1,000 and disqualified her from driving all vehicles for 12 months.
