Cannabis tourist bailed after appeal
A 59-year-old American tourist who is appealing a month-long jail sentence for importing cannabis was bailed by a judge.Edith Lord Wolff, of California, was caught with the drugs inside her luggage when she arrived on May 17 on a flight from New York. She admitted importing the drugs , which weighed 35.6 grams, but said she needed it for medical reasons. Lawyer Mark Pettingill told Senior Magistrate Archibald Warner his client has visited friends and family in Bermuda for “a number of years”.He said she was prescribed medical marijuana because she suffered from chronic Meniere's disease, an ear disorder that causes dizziness. Mr Warner said: “I hear you, but I don't care. In California, you can apply for a firearm licence. It can't be a mitigating factor.”He said the prescription had no validity in Bermuda, or in a state outside California. He also noted it was a “substantial amount of drugs,” and as a regular visitor, Wolff must have been aware of Bermuda's laws. Wolff, a self-employed investor with no previous convictions, cried out from the dock as Mr Warner fined her $3,000 plus a month in jail.Mr Pettingill filed an appeal with the Supreme Court after the hearing. Late Friday afternoon, he was successful in obtaining a hastily-convened bail hearing before Puisne Judge Charles-Etta Simmons who agreed to bail Wolff until an appeal can be heard. A date for that has yet to be scheduled.
