I was eating pizza, not having sex, claims accused
A teenager accused of having sex with an 11-year-old girl told a court he had merely spent the evening in question playing on his computer, eating pizza and kicking a ball against a wall.
The defendant, 'Mr. A', said he had no idea what was going on at the same time between his two friends — aged 15 and 13 — and the alleged victim, 'Miss X'.
Supreme Court has previously heard all three boys had oral sex and full intercourse with Miss X in a cellar at Mr. A's home on May 5, 2007.
Mr. A, aged 16 at the time of the alleged offence but now 18, took to the stand yesterday to deny any sexual involvement with the girl — and claimed she had in fact made advances toward him.
He said he was playing a game of 'one bounce one touch' football with his two friends when Miss X "just appeared" and the other two went over to talk to her.
"I carried on playing football. I kicked the ball against the wall," he told the jury. "Then when they were walking towards the back, I went left towards the front door and I went inside."
Asked by Deputy Director of Public Prosecutions Michael McColm why he had left the others, Mr. A replied: "I don't remember. I remember ordering a pizza and I was hungry because I didn't have any food.
"I ate some pizza, then went back outside, down the front and walked left towards the back of the house. I was curious about what they were doing outside because they didn't come inside for some pizza."
Mr. A said Miss X said something to him and he approached her because he couldn't hear her properly.
He continued: "As I moved closer to her she had pulled my shirt towards her body, by reaching out and grabbing my shirt. I simply just pushed her off my shirt. I said to her: 'No, you are too young.'
"I thought she was going to try and pressure me into doing something."
He said he went inside to play on his computer, and 20 minutes later he was joined by his two friends. He said they did not tell him what they had been doing and that he didn't ask. They continued to play on the computer and eat pizza, he said.
Mr. McColm put it to Mr. A that instead of going inside he had taken Miss X into the cellar where they had intercourse and oral sex, and that he was aware each of the other two also had sex with her.
Mr. A denied the suggestion.
The jury has previously heard Miss X told the boys "no" before they each had oral sex and full intercourse with her. Mr. A alone stands charged with having unlawful carnal knowledge of Miss X. None of the parties can be named for legal reasons.
The case continues.
