the Senior Magistrate was yesterday sent to prison for three months for breaking into his sister's home and stealing two pairs of jeans and a shirt.

Andre Simmons committed the offence on March 8.

Prosecutor Sgt. Peter Giles said Simmons walked into his sister's home through an unlocked sliding glass door.

Once inside he stole a pair of blue jeans, a pair of denim pants and a shirt valued at $116.

Family members saw him wearing the items and he was arrested on April 7.

Simmons who pleaded not guilty at a later court appearance, failed to show for his trial.

Yesterday Senior Magistrate the Wor. Will Francis asked him to explain why he failed to show up.

Simmons said he had a death in his family and had forgotten.

He said he went to the Police prosecutions department and spoke to P.c.

Christopher Terry who he claimed told him to await a call regarding his new court date.

However, when asked, P.c. Terry, who is one of the Magistrates' Court officers denied ever having told Simmons anything.

Upon hearing this, Simmons became agitated and launched into a screaming diatribe.

Mr. Francis listened for two minutes, and then ordered P.c. Terry and P.c.

He returned ten minutes later in a more subdued mood and he wanted the whole affair over with.

"I'm tired of all the stories and this whole thing. I just want it to be over. I need psychiatric treatment. I'll change my plea to guilty.

After Sgt. Giles read the facts, Simmons told the court he was living with his sister but they had a falling out.

"I just returned to get my things,'' he said. "Those clothes just got mixed up with mine.''
