jury yesterday after the two man-ten woman panel was unable to agree on a verdict.

Lightbourne, who was represented during the eleven-day trial by Mr. Archie Warner, was charged with stealing a cash register and approximately $700 in an early morning hold-up at Roosters restaurant last January.

Lightbourne claimed he could not have robbed the Court Street takeout chicken outlet because he was peddling cocaine on Princess Street at the time.

Yesterday, Mr. Warner's characterisation of the prosecution's evidence as "circumstantial'' and "speculative'' appeared to have persuaded at least some of the jurors, who having gone out at 11 a.m., stated at mid-afternoon that they could not reach a verdict and were ordered by Puisne Judge the Hon.

Mr. Justice Meerabux to try again.

At around 4.30 p.m., however, the jury forewoman announced a similar impasse.

"Have you reached a verdict?'' the court clerk asked of the panel.

"No,'' the forewoman replied.

"Were at least nine of you able to agree?'' the clerk said.

"No,'' the forewoman repeated.

At that point the judge accepted the jurors' inability to agree and dismissed them from further duties.

The judge then set a new arraignment date of December 5. Crown Counsel Mr.

Peter DeJulio recommended that Lightbourne be remanded in custody until then.
