The Wor. Mrs. Cheryl-Ann Mapp was convinced the driving offences occurred on April 15, 1991, but was not satisfied that Michael J. Nisbett was on the motorcycle.

"I have a lurking doubt as to the identity of the rider,'' Mrs. Mapp told Nisbett, 21, of Bobs Valley Lane in Somerset. "I must give you the benefit of that doubt.'' A Police officer had testified he was on foot patrol on Somerset Road in Sandys when he spotted a cyclist approaching him "at excessive speed''.

The officer signalled the rider to stop, but instead he made a U-turn and fled, court was told.

Later the same day, the officer spotted the cyclist again, and this time pursued him in a vehicle, court was told. Again the rider got away, but he abandoned the bike.

Nisbett was ticketed several months later for disqualified driving, dangerous driving, failing to stop at the request of Police, having no third-party insurance, driving an unlicensed cycle, and driving an excessively noisy cycle.

Nisbett, supported by a witness, testified he was not the rider. He said he accompanied his mother to Hamilton that day and did not return until the following day.
