Police prosecutor Sgt. Earl Kirby said Viera was involved in an accident between a car and motorcycle at the junction of Front Street and Court Street on September 21.

Police officers said Viera's breath smelt of intoxicants and he admitted he had "had a few.'' But Viera refused to take a breath test saying: "I don't see why.'' After he was taken to the Hamilton Police Station he again refused to take the test saying: "I don't have to and I don't care to.'' Acting Senior Magistrate the Wor. Charles-Etta Simmons disqualified Viera from all vehicles for 12 months and fined him $400.
