William Clemons is charged with having telecommunications apparatus and operating a system without having a licence, causing harmful interference and using threatening behaviour.

But Crown counsel Larry Mussenden explained to Acting Magistrate Wilhelm Bourne that, because of "an administrative oversight'' the equipment Clemons is accused of using was not delivered to court.

And lawyer Michael Scott, representing Clemons, explained he also wanted the case to be postponed because he had another appointment, Mr. Bourne had no option but to adjourn the case.

But he warned both attorneys that in future, trials will have to be heard on their appointed date.

"I would not like to encourage too many adjournments,'' he said. "The court calender is already crowded and cases must go on when they are set otherwise there will be backlogs and we don't want to encourage that.

"I want to try this case -- it's a very interesting case -- so next time please let's get it together.'' The trial was adjourned until December 21.
