to assault and obstructing a Policeman.

Henry Santucci, 38, of Knapton Hill, was given the option of paying $500 in fines by Acting Senior Magistrate Edward King.

But after Santucci explained he could not pay the fines because he was already serving a prison term -- for other unpaid fines -- Mr. King had no option but to return him to prison.

Prosecutor Sgt. Philip Taylor explained how officers were called to Princess Street, Pembroke at about 9.15 p.m. on June 26 where they found Gladwin Gilbert with dry blood around his mouth.

Mr. Gilbert told them that he had been repeatedly punched in the mouth by Santucci.

When Police arrested Santucci on July 3 he told them that he had only slapped Mr. Gilbert on the mouth a few times.

In another instance, Police officers stopped Santucci and another man on Princess Street at 3.10 a.m. for a drug search.

Santucci ran away from the officers and was seen throwing something that looked like a crack pipe over the roof a house.

He was later found by officers in the underbrush at Dellwood School covered in leaves.

Santucci's 28-day sentence will run concurrently with his other prison term.
