Woman tells of alleged assault outside club
A woman who alleges she was attacked and injured outside a club gave evidence in Supreme Court yesterday.
Gloria Maria Hayward Cox, 44, told the court that Wendy Harvey attacked her with a broken bottle on July 11, 2005, outside Hamilton Parish Workman’s Club, resulting in wounds to both her shoulder and back requiring nine staples.
Harvey, of Northchurch Lane, Hamilton Parish, denies wounding Ms Hayward-Cox and Gene-Anne Bean with intent to cause grievous bodily harm.
She is alleged to have caused facial wounds to Ms Bean with a bottle.
During examination by Crown Counsel Robert Welling, Ms Hayward-Cox said she had been drinking at the club when she heard her friend, Gene-Anne Bean, had been injured outside.
She told the court: “I was sitting at the bar when this happened. A friend of mine came running inside screaming ‘Gene-Anne, Gene-Anne’. I asked her what’s wrong with Gene-Anne.
“I got up from the bar, I went outside. When I got outside I asked what happened. She (Ms Bean) said ‘Wendy’.’’
Ms Hayward-Cox said that Ms Bean looked “stunned” and “shocked” and added: “She had blood coming down her face.”
Ms Hayward-Cox told the court that earlier that evening she had seen Ms Bean, the club secretary, trying to escort Harvey out of the club, which she had been banned from.
She said: “Gene-Anne escorted her out and she (Harvey) left, no problem. That would have to be about 11.30 p.m., 12 a.m.
“She (Harvey) came back into the bar — about 15, 20 minutes later. Gene-Anne went and approached her again,” Ms Hayward-Cox said.
According to Ms Hayward Cox’s testimony, she then confronted Harvey about the attack, she said: “I wasn’t mad — I said why would you do something like that?
“She started hitting me. I hit her back, I punched her, I don’t know where but I punched her,” she said.
During cross-examination, Harvey’s lawyer, Elizabeth Christopher suggested to Ms Hayward-Cox that she was feeling “hot, meaning somewhat intoxicated,” when the incident occurred. Ms Hayward-Cox denied the statement. She also denied further suggestions from Ms Christopher that she went charging towards Harvey “like a pitbull” when she got out of the club, and denied throwing the first blow in the altercation.
