Court of Appeal orders retrial in murder case

A man accused of murder will face retrial after a ruling by the Court of Appeal.

Davin Dill, 26, was charged with murdering 22-year-old Joshua Rowse along with possessing a bladed article, specifically a knife, in a public place on June 14, 2020.

The case went to trial in 2023 but on September 8 that year, after legal arguments held in the absence of the jury, the trial judge directed the jury to enter verdicts of not guilty.

The Crown subsequently launched an appeal against the decision, with the matter dealt with at a two-day hearing in March.

In a ruling handed down on May 5, the Court of Appeal unanimously allowed the appeal and remitted the matter back to the Supreme Court for retrial.

A press summary provided by the court said: “The court decided that the case should have been left to the jury, but noted that the Crown presented its case in a different way to the way in which the case was argued before the trial judge.”
