Seventeen-year-old Justis Smith, of Deepdale Road East, Pembroke, was fined $1,300 for assault, obstruction, violently resisting arrest and using offensive words.

Smith -- who has been charged with the premeditated murder of 17-year-old Canadian visitor Rebecca Middleton this summer -- was also bound over for 12 months for obstructing a Policeman.

His father, Richard Smith, was fined $1,150 for assault, obstruction and violently resisting arrest.

The pair had denied the charges during a Magistrates' Court trial. But yesterday Magistrate Edward King found the case proved.

The charges related to an incident on February 1 at Deepdale Road in Pembroke.

The court had heard how Police went to the road acting on a tip.

Det. Con. Barry Richards testified he and other officers found two groups of people.

He said he saw Det. Con. Lendra Davis fall during a struggle with Justis Smith, who then ran off.

Officers caught up with him and told him he would be arrested, Det. Con Richards said. That is when he became violent.

Det. Con. Richards said Justis Smith began to swing his arms violently, striking Det. Con. Clinald Burgess in the mouth.

He added Richard Smith then approached and was told not to interfere because his son was under arrest.

Smith Sr., however, ignored the warning.

Yesterday, Mr. King said he was satisfied beyond reasonable doubt that Justis Smith had committed the offences alleged.

He also cast doubt on Richard Smith's testimony, preferring the evidence of the Police.
