Man tried to snatch cannabis back from police
A 31-year-old Sandys man who tried to grab his cannabis back from police has been fined in Magistrates’ Court.Eugene Edward Simmons, of Whale Bay Road, admitted the November 26 offence, but told Senior Magistrate Archibald Warner that police had used excessive force.The court heard from Crown counsel Takiyah Burgess that police had been engaged in stop and search operations on Vesey Street, Devonshire, when they stopped Simmons on a motorcycle. They observed that he appeared nervous, and there was a scent of cannabis from his clothing.A search uncovered a hand-rolled cigarette containing plant material in Simmons’s jacket pocket, and he was placed under arrest.However, as the cigarette was handed to another officer to be bagged, Ms Burgess said a struggle ensued as Simmons tried to wrestle it back.The torn remainder of the cigarette went into the evidence bag, and Simmons was handcuffed and put in the police car. A plastic twist was found in the lining of his helmet, containing 4.1 grams of cannabis. Traces of cannabis were also found on the cigarette.Simmons told Mr Warner: “I’m guilty of having marijuana in my possession. I did take it from him, but there was no struggle.”He said seven officers had thrown him to the ground to handcuff him, and that he had been kicked and caused to vomit.Mr Warner said: “You snatched the seizure back from him and all of a sudden you turn peaceful.”Simmons replied: “I may have been aggressive, but I was not inflicting harm on anyone.”Mr Warner fined him $1,000 for possession of cannabis, plus $500 for obstruction of justice, to be paid by June 20.
