Man threw bag of potatoes at wife

A 47-year-old man was handed a conditional discharge in Magistrates’ Court after throwing a bag of potatoes at his wife “in the heat-of-the-moment”.Guilbert Araujo, from Sandys, pleaded guilty to assault.He and his wife, Maria, had been married for 17 years and have two children.On Saturday Mrs Araujo returned home and heard the defendant having an argument with their son. She got in between the two to prevent the matter from escalating, and Araujo’s aggression turned on her.Araujo threw a five-pound bag of potatoes at his wife “resulting in the reddening of the skin”, said prosecutor Cindy Clarke.Duty counsel Leo Mills said: “It appears this was in every sense of the word a domestic dispute that got out of hand and escalated quickly, but it does seem to me this obviously was the spur-of-the-moment.“And this is the first time in my experience and perhaps yours as well that someone has been accused of assaulting someone with a bag of potatoes.”Mr Mills said Araujo was “remorseful and understands he should have handled it with a bit more discretion but it was in the heat-of-the-moment”.He said Mrs Araujo sustained no significant injuries and argued the defendant should be let off with an absolute or conditional discharge.Senior Magistrate Archibald Warner said: “This is a matter that shouldn’t be in this court this morning wasting the court’s time and money.“He and his wife got into a fight and he threw a bag of potatoes at her. It’s not for me to judge if that was right or wrong. This is a serious criminal court.”He said it was up to the prosecution to use discretion when bringing matters before the court.“I would never encourage domestic violence but there must be a limit,” the magistrate added.He handed Araujo a conditional discharge for 12 months; meaning if he does not appear back in front of the courts in the next year a criminal conviction will not be recorded against him.
