Two motorists banned from the roads for impaired driving

Two motorists caught drinking and driving over Cup Match were yesterday banned from the road for a year.

Eugene Tuzo, 55, from Pembroke, and Anika Smith-Picchia, 40, from Sandys, both pleaded guilty to driving with more than the legal limit of alcohol in their blood system. Both offences took place in the early hours of July 28. Crown counsel Kirsty-Ann Kiellor said police on mobile patrol on Court Street saw a car driven by Tuzo travelling at a high rate of speed.

The officers stopped Tuzo. During a brief conversation they noticed that his breath smelled of alcohol and he appeared unsteady on his feet.

Asked if he had been drinking, Tuzo told the officers that he had three beers.

A breath test revealed that Tuzo had 172ml of alcohol in 100mg of blood, more than double the legal limit of 80ml.

An hour-and-a-half after Tuzo was stopped, officers responded to a reported collision on South Road in Southampton.

They found a car in the North lane with a utility pole resting on the roof and Smith-Picchia sitting in a nearby vehicle.

Smith-Picchia’s breath smelled of alcohol. The officers asked if she had been drinking. She responded that she had one drink on a cruise an hour earlier.

A breath test showed she had 178ml of alcohol in 100mg of blood. Yesterday she apologised to the court, saying the choice to drive after drinking had been a bad call.

Senior Magistrate Archibald Warner fined both Smith-Picchia and Tuzo $1,000, and disqualified them from driving all vehicles for 12 months.
