Trio who admitted fighting will be sentenced Friday

The sentencing of three young men who got into a brawl was delayed after a prosecutor was unable to provide background information.The delay prompted complaints from Senior Magistrate Archibald Warner and from a lawyer representing one of the men.Micah Fubler, 21, Tahj Robinson, 18, and Tahva Virgil, 17, admitted on Monday to taking part in a fight on College Road, Paget, around 2.48am on Saturday.Crown counsel Larissa Burgess told Magistrates’ Court that a party had been held in the area.As police looked on, a fight broke out between several people including the defendants, whom the officers noticed throwing punches and “ferocious” kicks.Robinson knocked down another fighter, who has not been brought before the courts, and began punching him on the ground.Ms Burgess said after repeated warnings, officers used a Taser gun on him.Robinson later told the officers “I didn’t fight”; Virgil said his involvement was in “self-defence”.Yesterday, Virgil’s lawyer Elizabeth Christopher said: “My client was minding his business and a young man who had too much alcohol came and hit him four times before he tried to protect himself. A police officer saw, and (that’s why) he’s here today.”Senior Magistrate Archibald Warner said on Monday that he was unable to sentence the men until he had details of Virgil’s previous convictions, which Ms Burgess did not have available.He adjourned the matter until yesterday morning, remanding Virgil and Robinson into custody in the meantime. Fubler was bailed.According to Mr Warner, Virgil has previously been convicted of kidnap, and given three years’ probation.However, Ms Burgess told him yesterday that she was still unable to provide full information on previous convictions.“The (court) record is not complete but it is my understanding that he’s not been co-operative with his probation and is deemed unsuitable for community supervision,” she said.She added that Virgil was on bail at the time of the fight and had been ordered by the court not to be in the company of one of the other participants in the fight.Mr Warner complained: “I said yesterday (Monday) there’s no way I can effectively and properly deal with this unless I know what I’m dealing with.”Ms Burgess said the 24-hour adjournment had not given her enough time to find the court file, which was “in transmission”.“What do you mean, it ran away?” chided Mr Warner, as he adjourned the case until Friday for sentencing.Ms Christopher complained that Virgil should not have to remain in custody while the prosecutor locates the file.She asked that he be allowed to change his plea to not guilty on the basis of self-defence but Mr Warner said that will have to be discussed on Friday.Robinson, who was convicted of attempted burglary last December, is currently awaiting trial on two further matters, one of which is an alleged burglary.Mr Warner remanded him and Virgil into custody until Friday and bailed Fubler.
