Judge orders additional treatment for man who punched woman
A teenager who bound a mentally challenged woman with duct tape and punched her in the face looks set to avoid a prison sentence.Nearly three years after committing the offence, William Smith should finally find out his punishment later this month, most likely probation and a rehabilitation programme, Supreme Court heard yesterday.Smith, now 19, was 16 when he tricked his way into the 53-year-old victim’s home in Alexander Road, Devonshire, in March 2009, by claiming he was a student at Berkeley Institute.He bound her ankles and pulled a cloth over her eyes before striking her twice in the face, causing swelling and small cuts.Smith, also of Alexander Road, pleaded guilty in December 2010 but has been on bail awaiting sentencing as the court considered reports about his own mental health.Yesterday, his lawyer Elizabeth Christopher told Supreme Court Smith has shown a willingness to become a positive member of society and the best way of sentencing him would be to place him on a community-based treatment programme to address concerns raised by psychiatrists.Puisne Judge Charles-Etta Simmons adjourned the case for two weeks so that the appropriate treatment can be found, after noting it doesn’t exist in Westgate and could prove expensive.Mrs Justice Simmons told the court: “My concern is that the defendant should recognise the seriousness of his behaviour.“Perhaps, given the circumstances for the need of the treatment and unavailability of the treatment in the Westgate facility, perhaps that can be dealt with by way of a suspended sentence. He clearly deserves treatment. I believe that the community will benefit from him having an adequate treatment.“I believe he’s shown that he is aware of his offending behaviour; he’s aware of his problematic background; he’s aware that with treatment it’s only going to help him achieve the goals he’s set himself.“My biggest issue is him getting that treatment. Money seems to be the problem now.“If we don’t address the psychological issues in our youth at the earliest opportunity and in the most adequate way, we are going to end up with serious problems on our hands.”The matter was adjourned.
