A sexual predator yesterday admitted assaulting a teenage girl while on probation for a nearly identical attack.Dwayne David Beach, 47, pleaded guilty to one count of sexual assault and one count of intruding on the privacy of the 16-year-old on January 22.Prosecutor Carrington Mahoney told Magistrates’ Court that the victim, who cannot be named for legal reasons, was walking along First Avenue in Devonshire when Beach approached her.The Happy Valley Road resident made conversation with the schoolgirl and then grabbed her by the arm and pulled her into a nearby yard.He pushed the victim against a wall where he played with her hair and kissed her.Beach groped the teenager’s chest and attempted to kiss her mouth but she punched him in the face and escaped.She ran to Middle Road, where she got on a bus and continued home. Once there, she told her mother of the attack and called the police.Officers took a statement from the victim, and collected DNA samples from her neck.Beach, a construction labourer, was arrested the next day when he denied any involvement in the incident.He told officers that he had spent the entire day at his godmother’s home.Beach was later identified by the victim in an identification parade and, in a subsequent interview with police admitted sexually assaulting the girl.He told police that he gave the girl $5 and kissed her hand when she walked away.The court heard that Beach was on probation at the time for a similar assault on a young girl in 2010.In that incident, Beach approached a 14-year-old girl on her way to school.He pulled her between two cottages where he pressed his body against hers and gyrated.Beach told that victim: “If you do not tell anyone [about this] I will spoil you.”He pleaded guilty in that case to two counts of touching the teen for a sexual purpose and one count of invading her privacy.He apologised to the court and insisted he had learned his lesson.Magistrate Khamisi Tokunbo described that attack as “predatory and almost animalistic in nature”. He sentenced Beach to 18 months in prison followed by two years’ probation.Defence lawyer Kenville Savoury yesterday told the court that both incidents were tied to the defendant’s heavy drinking.“The underlying reason for this offence is the fact that the defendant was under the influence of alcohol at the time,” Mr Savoury said.“When he is not under the influence of alcohol, he is a perfect gentleman. For some reason, when he is under the influence of alcohol, these things sometimes happen.”Senior Magistrate Archibald Warner called Beach a dangerous man and a predator, noting the previous attack took place under almost identical circumstances.He committed the matter to Supreme Court, where Beach could receive a harsher penalty.“The maximum penalty down here is five years in prison,” he said. “Even in light of that guilty plea, I don’t believe that the sentencing powers of this court are enough.“If I had the power to sentence him to more than five years, I would sentence him to more than five years, so he has got to go.”Mr Warner ordered a Social Inquiry Report be carried out on Beach and remanded him in custody until his sentencing.
