Man admits using girlfriend’s father’s card to steal cash

Leroy Henderson pled guilty in Magistrates’ Court yesterday to a charge of theft committed on January 23 in Sandys.The court heard that complainant Winston Godwin lives on Longbay Lane in Sandys. The theft was not discovered until his wife went online to check the balance of their joint account.The withdrawals were made at the ATM machine outside of the Somerset MarketPlace, $300 in the first instance and $200 in the second.Senior Magistrate Archibald Warner wanted to know how the defendant knew the pin number to access the couple’s account. Duty counsel Oonagh Vaucrosson told the court that the defendant had seen his girlfriend use the card and made a mental note of the pin number.She also noted that Henderson and the complainant’s daughter have a 12-month old son and that the child was in dire need of necessities. “He used the case to purchase diapers and formula for the baby,” she said.Mr Warner said he didn’t understand “the stealing part of this case” when it appeared that the family involved was a “functional family”.At one stage complainant Mr Godwin asked to speak and said: “We’ve been looking after his son for quite some time. This man climbed up into our bedroom window while we were downstairs eating,” he said.“He don’t take care of the child, he’s been breaking into my home and he’s not welcome in my house. My daughter, who is 21, has since moved out.”Mr Godwin added that at one point his wife saw Henderson in their yard and found him inside the house the next day.Henderson apologised to the court for his actions and said he would like to make restitution.Mr Warner asked the defendant if “he’s sticking by his story about looking after his child and using the money to buy his son’s necessities”. Mr Henderson replied: “Yes.”His case was set down for April 30 for sentencing, pending the findings of a social inquiry report and he was released on $2,000 bail. But he was also ordered to pay fines as a result of two outstanding warrants.He was convicted on January 13 for riding an unlicensed motorcycle and two counts of riding the bike without insurance. The $1,500 in fines must be paid by April 19.
