A Warwick man caught drinking and driving while already banned from the road, had his disqualification extended until 2015.

Sinclair Amos, 21, pleaded guilty in Magistrates' Court to driving while impaired and driving while disqualified on April 14.

Prosecutor Garrett Byrne told Magistrates' Court that Amos stopped on Middle Road in Devonshire in the early hours of the morning.

He admitted that he had been drinking and did not have a valid driver's licence.

The officers discovered that Amos was banned from driving all vehicles for two years, with his licence to be reinstated next January.

Amos told the court: “It was just a bad decision. The guy driving the car was a lot drunker than I was, so I thought it was safer if I drove.”

Senior Magistrate Archibald Warner used a cricket metaphor to explain Amos' problem.

He said he was “mashing the crease”, and at risk of receiving a prison sentence.

“You have been disqualified having accumulated more than 12 demerit points and now you have not only gone and drove while disqualified, but you were impaired, which in law enables this court to sentence you to a term of imprisonment.”

Despite that, he fined Amos $500 for driving while impaired and another $500 for driving while disqualified. He disqualified Amos from driving all vehicles until April 15, 2015, for the impaired driving offence.

According to a Police spokesman, a total of three people were arrested over the weekend on suspicion of impaired driving.
