A jury heard how a man struggled with his would-be shooter in the middle of the street after being targeted in a daylight attack.

Another man ran into the fray, but prosecutor Carrington Mahoney alleged he was attempting to help the shooter.

The gunman fled after firing several shots, but had to abandon his motorcycle after crashing into a car.

Mr Mahoney said: “The Crown says the shooter was Jahmico Trott and Troy Burgess Jr came to his aid and assisted to enable him to shoot the complainant.”

Both Mr Trott and Mr Burgess have denied charges of attempted murder and using a firearm to commit an indictable offence.

Mr Burgess has also denied handling a firearm and carrying it with the intention of committing an indictable offence.

Their trial began in the Supreme Court yesterday with Mr Mahoney detailing the Crown’s case.

Mr Mahoney said all of the offences relate to an incident that took place at about 6pm on May 14, 2017, Mother’s Day.

He said: “The complainant was visiting his cousin who lived in an apartment on the top of Bulldogs, a bar on Court Street.

“While they were up there, a person came across the road armed with a firearm.”

Mr Mahoney said the man was wearing a red bandana over the lower half of his face and dark clothing.

The complainant and his cousin heard a knock on the door, but before they answered it, the cousin looked out from the balcony to see who it was outside.

Seeing the gunman, the pair attempted to escape.

The complainant leapt off the second-floor balcony and ran towards his motorcycle, which was parked near Jamaican Grill.

Mr Mahoney said: “The person saw the complainant trying to start the bike, which wouldn’t start, and pointed the gun at him.

“The complainant ran into him and they started to struggle.”

Mr Mahoney said the gunman fired several shots, but was pulled to the ground.

As the struggle continued, the complainant began to get the upper hand.

He said: “Mr Burgess came over and it’s our case that he was seeking to assist the shooter.

“He was trying to grab the complainant. We say he was dragging him off the gunman when he was getting the best of him.”

As the struggle continued, further shots rang out.

When the pair separated the complainant ran towards Hamilton Police Station.

The shooter ran towards a nearby parking lot to a waiting bike, but as he attempted to pull out on to Union Street, he struck a passing car.

Mr Mahoney said the gunman then abandoned the bike and fled on foot.

The trial continues.
