Fine and roads ban for man who refused to take a breath test

Magistrates' Court

A man who refused to take a breath test when he was stopped by police carrying out roadside sobriety checks has been disqualified from driving all vehicles for 18 months.

Samuel Fisher, 52, from Pembroke, admitted to refusing to take a breath test when he appeared in Magistrates’ Court yesterday.

The court heard that officers who were doing sobriety checks on Crow Lane stopped Fisher, who was riding his bike, last month.

Fisher gave police a breath sample at the scene, which revealed 162 milligrams of alcohol in 100 millilitres of blood. The legal limit for driving in Bermuda is 80mg/100ml.

However, Fisher did not take the test at the Hamilton Police Station, despite being ordered to do so.

In addition to the ban, he was fined $1,500.
