Man faces $4,000 fine for two drink-driving incidents
A man was ordered to pay $4,000 after he admitted drink-driving on two occasions within a week of each other — one of which ended in a collision.
Ross Parsons, 54, pleaded guilty in Magistrates’ Court on Tuesday to two counts of driving while impaired and two counts of refusing to take a breath test.
The court heard that police were monitoring traffic in the area of Spanish Point in Pembroke and on North Shore Road following a party at Spanish Point Park.
Police were called to a motorcyclist on Spanish Point Road who stopped in the middle of the carriageway and was obstructing traffic.
Officers tried to move the motorcyclist, who was discovered to be Parsons, and he became aggravated.
Police suspected Parsons was intoxicated because he struggled to hold up his bike and smelled of intoxicants.
When he refused to take a breath test, police arrested Parsons and took him to Hamilton Police Station.
They once again asked him for a sample of breath for analysis, but Parsons told officers: “I am a free man, I can do whatever I want.”
The incident happened on June 14.
The court also heard that on June 20, police were called to a road traffic collision involving two vehicles on Court Street.
When police arrived, the driver of a car told officers that a motorcyclist had run a red light and caused her to swerve.
The motorcyclist, revealed to have been Parsons, was seen swaying on the side of the road with a broken liquor bottle nearby.
Police took a brief sample of breath for analysis and arrested him.
While at the Hamilton Police Station, police demanded another sample of breath for an official analysis, but Parsons refused on the grounds that he already gave a sample.
Despite being told police needed another sample and refusal to comply was an offence, Parsons still denied them a sample of breath.
Senior magistrate Maxanne Anderson asked him if alcohol had an impact on his life. Parsons, from Hamilton, said he was “positive” it did not.
Ms Anderson fined him $1,500 and banned him from the roads for 18 months for the first incident.
She further fined him $2,500 and banned him from the roads for three years for the second.
