Rider caught with open bottle sent to DUI Court

A man caught riding a motorcycle with an open beer bottle was banned from the roads until further notice after he refused a breath test.

Kacy Greene, 26, from St George’s, pleaded guilty in Magistrates’ Court to a charge of refusing to provide a breath sample in an incident in November.

The court heard that at about 5.50pm on November 29 officers were on mobile patrol on North Shore Road in Hamilton Parish when they saw a motorcycle, driven by Greene, pull out of Workmen’s Lane.

The officers said the rider appeared to accelerate quickly, almost losing control of the motorcycle and causing vehicles in the westbound lane to take evasive action to avoid a collision.

Greene was subsequently stopped near My Lord’s Bay Road and officers noticed that he smelt of alcohol and had an open, partially consumed bottle of beer on him.

As the officers asked for a breath sample, he was allegedly adamant that he would not take the test.

The court heard that Greene is already before the DUI Court programme for an unrelated incident.

Magistrate Maria Sofianos sent the matter to DUI Court, releasing Greene on $1,500 bail and banning him from driving any vehicles until a further order.
