Sex attacker sentence cut by five years

A man convicted of a brutal sexual assault after breaking into a family home has had his sentence reduced.

Last February, Kijon Baker was sentenced to 25 years imprisonment for serious sexual assault and eight years for aggravated burglary, with the sentences to run concurrently.

Baker had “brutally raped” a woman in her home as her two young children watched on November 4, 2014.

“In our judgment, taking account of the assistance in the guidelines and the authority of this court in Selassie, a case bearing a number of similarities, we think the appropriate sentence is 20 years’ imprisonment for the serious sexual assault and eight years concurrent for the aggravated burglary,” the written judgment by Court of Appeal president Sir Scott Baker said.

Kijon Baker will not be eligible for parole for ten years.

“The judge’s direction that time spent in custody is to be taken into account remains undisturbed,” the judgment said.

However, an appeal against the conviction was dismissed.

“We have no doubt about the safety of the conviction,” Sir Scott Baker wrote.

A “moving” victim impact statement was read as part of the examination.

“The offence has had a very serious and ongoing effect on her life,” the decision reads. “The conjunction of a very serious sexual assault and an aggravated burglary inevitably requires a long sentence of imprisonment.

The act involved aggravating features, the judgment said.

“The sexual assault was committed at night in the victim’s own home when she was asleep in bed and, even worse, her two small children were present,” the decision said.

“There was no mitigation.”

At his sentencing, Kijon Baker claimed he had committed himself to Christ after finding a new purpose in life while imprisoned.
