Man referred to DUI Court after crash
A man was referred to DUI court after he admitted crashing his motorcycle and refusal to take a breath test.
Jermaine Harvey, 37, pleaded guilty in Magistrates’ Court to refusal to take a breath test after he was suspected of drink driving.
The court heard last Thursday that police attended the scene of a traffic accident after a motorcyclist lost control of his bike and crashed near the intersection of South Road and Tribe Road No. 1 in Warwick.
The rider, later identified as Harvey, slipped in and out of consciousness and was taken to the King Edward VII Memorial Hospital for treatment.
Officers suspected him of drink driving and demanded a sample of blood for analysis, but Harvey refused.
Harvey was arrested and taken to Hamilton Police Station after his treatment, where he refused to take a breath test.
The incident happened on September 3.
He at first told the court “my breaks were bad” and added “I just didn’t want to give blood”.
But he later admitted that he wanted to enrol in the DUI programme.
The court heard that Harvey, from Warwick, had been banned from the roads for a similar offence in 2016.
Senior magistrate Juan Wolffe adjourned the case until today and released Harvey on $500 bail.
