Act: The Inspector The inspector's role is to investigate either where the employee complains of a breach of the act or where the inspector has "reasonable grounds'' to believe that there has been a breach.

After making the relevant inquiries, the inspector will first attempt to get the parties to settle. If this is unsuccessful, and he feels that he has "reasonable grounds'' to believe that there has been a breach of the Act, the inspector must then refer the complaint to the Employment Tribunal.

If there is an alternative grievance procedure, the inspector must not refer a case to the tribunal without consent from both sides.

The tribunal The Employment Tribunal will be made up of up to five upstanding members of the community. At least one will probably be a lawyer or somebody who deals on a regular basis with employment issues.

Lay people will also sit on the panel who will take a more relaxed view than a formal court on how the process is conducted. If an employee or employer not be satisfied with the ruling of a tribunal, they can appeal to the Bermuda Supreme Court.
