C&W wins court battle with Digicel

LONDON (Bloomberg) — Cable & Wireless Communications Plc won a lawsuit filed by a Caribbean mobile phone company over allegations it blocked entrants to the telecommunications market.

Digicel Group Ltd., a Jamaica-based mobile-phone operator, had claimed in the lawsuit that Cable & Wireless had unlawfully delayed allowing Digicel to connect its network to the Cable & Wireless network.

Justice Paul Morgan dismissed the claim yesterday. Digicel had been claiming $100 million, he said. Cable & Wireless said in a statement that it will seek the reimbursement of its costs in the case.

Digicel claimed Cable & Wireless' actions were in breach of local laws passed to allow other entrants into the market. Cable & Wireless had previously been the monopoly telecoms provider in some Caribbean jurisdictions, the judgment said.

Digicel said it was "extremely disappointed" with the decision and was currently considering its legal options.
