Grape Bay's challenge now official

their challenge against the Crown over an act banning fast food restaurants with a foreign flavour.

Governor Thorold Masefield recently signed the Prohibited Restaurants Act into law.

And on Monday, a writ was filed in the Supreme Court registry that made real Grape Bay Ltd.'s intention to challenge the law in Supreme Court.

United Bermuda Party MP Maxwell Burgess, who, with ex-Premier and former MP Sir John Swan is behind the bid to open a McDonald's, has said that the legal move was not about burgers and fries -- but a Constitutional issue.

Ann Cartwright DeCouto, who piloted the Prohibited Restaurant's Act through Parliament, did not return several phone calls from The Royal Gazette yesterday.

The writ names as Plaintiff Grape Bay Ltd. The defendant is the Attorney General.

Lawyers Mark Diel of Smith Barnard and Diel is representing the Plaintiff.
