Prison for man who injured teen in cycle crash
A drunk driver who knocked a teenager off his motorbike — causing him multiple fractured ribs — has been jailed for a year.
Osvaldo Botelho Madeiros, 35, lost control of his bike and crashed into Jeffrey Smith in Harrington Sound Road, in the early hours of June 5 last year, Supreme Court heard on Monday. Portuguese national Madeiros, from Paynters Road, Hamilton Parish, attempted to leave the scene but was apprehended by another motorist, said Senior Crown counsel Carrington Mahoney.
Tests showed Madeiros had 140 milligrams of alcohol in 100 millilitres of his blood, well above the legal limit of 80 milligrams. He pleaded guilty at an earlier hearing to causing grievous bodily harm through driving while impaired, and driving while above the legal alcohol limit.
Madeiros and 19-year-old Mr. Smith were both taken to hospital as a result of injuries sustained in the accident.
Mr. Smith, from Paget, suffered a punctured lung and road rash as well as the rib fractures.
Madeiros suffered a wound to his left knee and fractured his right shoulder.
Venous Memari, defending, said Madeiros had co-operated with Police and entered an early guilty plea.
Speaking through an interpreter, Madeiros told the court he was very sorry.
Passing sentence, Puisne Judge Charles-Etta Simmons said: “There’s a prevalence of impaired driving while on the roads in Bermuda and the court has a duty when sentencing to take that into consideration.
“The court is responsible also to take into consideration the level of alcohol that’s found to be in your blood at the time after the accident. Yours was very high.”
For the grievous bodily harm charge, Madeiros was sentenced to a year in prison and banned from driving all vehicles for three years. For driving while above the alcohol limit, he was banned from driving all vehicles for two years. The driving bans will run concurrently.
