Man stabbed his brother five times

A 21-year-old man was sentenced to two years imprisonment in Magistrates’ court for stabbing his brother. Kyle Daniel Smith pleaded guilty at an earlier court appearance on February 23 to stabbing his brother, Kyhon Andrew Smith, five times on October 8 last year.

Crown counsel Cindy Clarke told the court at 9.05 p.m. on Sunday, October 8, Police and Emergency Medical Technicians (EMT) were called to a home in Loyalty Estates, Sandys.

Police and EMT’s found Kyhon on the driveway with five stab wounds in his back and he was taken to King Edward VII Memorial Hospital by ambulance. Police then noticed a man sitting in the back of their car, who had not been placed there by any of the officers, wearing blood covered clothes.

Smith admitted to stabbing his brother, was arrested and cautioned to which he responded: “How’s he doing?”

At KEMH, his brother’s life threatening wounds, which included both of his lungs collapsing and his aorta bleeding, required emergency surgery and he was airlifted to the United States.

On Monday October 9, Police interviewed Smith who told them he was fighting with his girlfriend in his bedroom at the family home when his brother tried to intervene. Infuriated, Smith threatened Kyhon with a knife. When Kyhon left the bedroom and went to the kitchen, Smith followed him. Smith then put Kyhon in a headlock and stabbed him five times.

In court Smith, of Loyalty Estate said: “I know this was a very serious crime. By giving me time I won’t be able to fix the relationship with my brother. That’s all I have to say.”

Andrew Smith, the boys’ father said: “There is nothing Kyle wouldn’t do for his brother. His brother, from day one, never wanted to press charges.

“To go to prison at 21-years old? I’ve seen men go to Westgate and come out hardened.”

Magistrate Khamisi Tokunbo said: “His brother hasn’t forgiven him and in the social inquiry report he vowed he would never speak to him again. He is lucky his brother is alive today. Given the grave nature of the crime imprisonment is necessary.”

Mr. Tokunbo then sentenced Smith to two years imprisonment, nine months to be served immediately and 15 months suspended for two years plus two years probation.
