Defendant did not hit alleged victims with bottle — claim
A Supreme Court jury heard claims that a defendant charged with assault and wounding did not hit her alleged victims with a bottle.
Wendy Margaret Harvey, of Northchurch Lane, Hamilton Parish, denies wounding Gene-Anne Bean and Gloria Maria Hayward-Cox with intent to cause grievous bodily harm.
She is alleged to have caused facial wounds to Ms Bean with a bottle outside the Hamilton Parish Workmen’s Club on July 11, 2005 and injuries to Ms Hayward-Cox’s shoulder, arm and back.
Crown counsel Robert Welling continued his cross examination of the defence witness Clarkie Darrell yesterday.
Mr. Darrell maintained Harvey was never in the club that night. He said he saw the fight and denied Harvey hit Ms Bean or Ms Hayward-Cox with a broken bottle. He also said it was Ms Hayward-Cox — also known as Maria — beating up Harvey while she tried to defend herself. Mr. Welling said: “So let me get this straight. You have Wendy Harvey on the ground trying to get up, Maria Cox raining blows on her and you’re just standing there watching?”
Mr. Darrell explained there was a group of about eight people in front of him and he had to push through them to break up the fight. He said he could still see the scuffle because he is 6ft 2ins and could see over the group.
Mr. Welling also suggested that Mr. Darrell was lying while on the stand. “I’m going to put it to you that you have told a story that is remarkably similar to Wendy Harvey and that you put your heads together. I’m going to put it to you that your recollection, Mr. Darrell, is being added to by conversations that you’ve had with Wendy Harvey?”
The witness disagreed saying: “I’m here to tell the court exactly what took place. Not to discredit Maria, Wendy or Gene-Anne. I’m not defending anybody. What it is is what I told you and that’s exactly what took place.”
Mr. Welling also suggested that Mr. Darrell was there to “assist Wendy Harvey rather than the jury”. Mr. Darrell disagreed.
Closing arguments and a summation by Justice Charles-Etta Simmons are due to place today.
