Rape accused claims former girlfriend agreed to have sex
A man accused of attempting to rape his ex-girlfriend and then actually raping her three weeks later has denied having anything other than consensual sex.
The 37-year-old defendant told a jury yesterday he only went to the woman's house on the first date in question after she invited him to pick up a gift.
Asked by his lawyer Llewellyn Peniston if he had any "intimate exchange" with her, he replied: "Absolutely not¿I had no intentions, no desire of any sexual activity taking place. That's why I was shocked when I was accused two days later of sexual assault.
"I was confronted by Police officers."
During her evidence earlier this week, the woman claimed he entered her home on the first occasion last year, stole $40 from her bag, sexually assaulted her and then injured her when she tried to snatch the money back.
She further alleged that the man entered her house without permission during a second incident, on her birthday earlier this year.
She said he raped her after threatening to slit her throat with a knife, and robbed her of $500 cash before driving his car into her legs.
The defendant rejects all of these claims, as well as further charges that he sent two intimidating letters to her from Westgate while on remand.
Neither the woman nor the man can be named for legal reasons.
Giving evidence in his own defence yesterday, the man said that during the first incident, the woman accused him of having started a new relationship. He said she tried to stop him leaving and took money from the pocket of his pants.
During a struggle that ensued, the man admitted he bit the woman on her thumb, but "not hard".
He said on the second date in question, the woman invited him to her home again to discuss the first incident, which she had reported to Police.
"I thought 'she's got a nerve calling me like this' ", the man told the court.
When he went there, he claimed the woman attempted to greet him with a hug and kiss at the door. He went on to tell the court that after she asked him to wish her a happy birthday, he asked why she was doing this to him.
"These are her exact words: 'I want you to feel hurt like you hurt me,' " he claimed.
The man told the jury his ex went on to tell him she planned to drop the charges, and after he comforted her because she was upset, they went on to have consensual sex.
He denied having a knife with him or threatening to use one, and claimed the woman voluntarily fetched him $500 from an ATM.
"Two days later, I was again accused of sexual assault," he told the court.
