Man given suspended sentence for riding motorcycle while disqualified

A single father was given a suspended sentence yesterday after he admitted his third offence of driving while disqualified.

Kofi Dill, 31, also pleaded guilty in Magistrates' Court to violently resisting arrest and threatening officers after he was stopped.

According to Crown counsel Kirsty-Ann Kiellor, Police were on patrol on Wednesday when they noticed Dill riding a motorcycle along North Shore Road in Pembroke.

Knowing that Dill was disqualified from driving, they pulled him over outside Grannie's Kitchen.

The officers approached Dill and he unleashed a torrent of profanities: "You f***ers never leave me alone. F**k off. Don't touch me or I'll f**k you up."

Officers attempted to handcuff him, but he began to struggle, lashing out and striking one officer in the face, causing bruising.

Dill had been caught driving while disqualified twice before, and had prior convictions for assault.

In Magistrates' Court yesterday, Senior Magistrate Archibald Warner warned him that driving while disqualified is considered contemptuous.

"This wasn't just [Wednesday]," Mr Warner said. "Once is bad enough, but this is the third conviction for driving while disqualified."

Dill admitted he was a "frequent flyer" in the courts but asked for lenience. He said he was almost solely responsible for taking care of his youngest child.

"I'm going to go to school soon and taking care of my child, and I'm taking my daughter with me," he said. "I'm doing right."

Mr Warner responded: "How can you say that you are doing right when you say 'I don't care what the court says, I'm going to ride my bike' and then, when the police stop you, you swear at them and assault them?"

Duty counsel Leo Mills told the court that he believed Dill was trying to put himself back on the right path, holding a steady job and caring for his child.

Mr Warner sentenced Dill to three months' imprisonment for the offences, but ordered the sentence suspended for two years.

He also fined Dill $500 for driving while disqualified, and $1,000 for each of the other offences. Mr Warner ordered Dill to pay the fines by Christmas Day.
