Clinton Simmons 37, of Rocklands Estate pleaded guilty to the charge.

Prosecuting Sgt. Kenrick James told the court that on March 1 at 5.42 p.m., Police were called to a single vehicle accident involving a car that had gone over an embankment.

"The car had landed in the yard of a private home demolishing part of a railing,'' Sgt. Kirby said.

"Simmons told Police he was travelling west on Middle Road when his attention was diverted by another matter.'' Officers asked Simmons whether he had been drinking and he told them that he had at noon but had eaten since then.

Sgt. James added that a breathalyser test showed that Simmons had 184 milligrams of alcohol in 100 millilitres of blood.

Senior Magistrate the Wor. Will Francis fined him $450 and disqualified him from all vehicles for 12 months.
