Mrs. Justice Wade directed the jury to return not guilty verdicts to two charges of unlawful and indecent assault and they will deliberate on the other four charges.

The girl who is now aged 12, claims that her father sexually assaulted her sometime between August, 1991 and December 31, 1994.

It is alleged that her 60-year-old father had unlawful carnal knowledge of the girl who was under the age of 14 years. The jury will also consider an alternative charge of incest.

The man has also denied one count of unlawful and indecent assault, and sexual exploitation of a minor by a person in a position of trust.

The girl previously told the nine-woman, three-man jury that her father first tried to have sex with her in 1992 when her mother went abroad to Las Vegas.

She said she told her friends about the incident last year and they told her to tell the school counsellor.

In her summation, Crown Counsel Charlene Scott told the jury that the complainant's psyche has been scarred forever and she asked the panel to change places with the complainant.

But Mr. Pettingill urged the jury to dispense with the emotionalism and look objectively at the issues.

He said he had serious concerns about the reliability of the complainant who was testifying about events that were alleged to have happened five years ago.
