Magistrates' Court on Friday when prosecution failed to prove its case.

In January, 23-year-old Tresa Robinson of Devon Springs Road, Devonshire and 26-year-old Kevin DeRosa were charged with attempting to pervert the course of justice.

DeRosa was further charged with knowingly making false or misleading statements to Police and driving a motor vehicle while disqualified.

Robinson was further charged with making false statements to Police.

On January 9, Mrs. Marion Paul was leaving a parking lot on Devon Springs Road in her car.

As she crossed the road, Northbound she collided with the motorbike allegedly driven by Robinson.

As a result Robinson fell and was pinned under the bike. She sustained abrasions to the face and hands. DeRosa was thrown from the bike, breaking his leg.

"The whole matter stems on Mrs. Paul's allegation that it was DeRosa who was riding the bike,'' the Wor. Charles-Etta Simmons said.

"P.c. Antoine Fox, who attended the scene of the accident, said within half an hour of the accident Robinson informed him that she was the rider.'' "Mrs. Paul, he stated, was shook up and he was unable to make a statement.'' Ms. Simmons added the Policeman stated that at the scene Mrs. Paul was unable to say who was riding.

Robinson and DeRosa had two witnesses who said they were on Devon Springs Road cleaning a car when they saw Robinson driving.

"I have observed all the witnesses. Mrs. Paul I believe is a witness of truth. She has no axe to grind with the defendants, however I can't ignore the fact that she was unable to say who was riding at the scene of the accident.'' She also said that there was no evidence of Robinson and DeRosa communicating with each other on what to say to the Police.
