Alphonso Randolph Benjamin, who has been an illegal alien in the United States for the past eight years, on Tuesday admitted in Magistrates' Court to uttering documents bearing false writing.

The court heard that the 34-year-old arrived in the Island on April 4 on a flight out of Boston, Massachusetts.

Benjamin presented a birth certificate and arrival card to Bermuda Immigration bearing the name John Henry Levins.

When he tried to board the return flight on Easter Sunday, US Immigration officers noticed that various documents in his possession had different names.

Under questioning by Bermuda Police, Benjamin admitted his true identity and said he had bought the birth certificate in St. Thomas in the US Virgin Islands for $200 in 1982.

Defense lawyer Mr. Kim White recommended that deportation back to Nevis be his client's sole penalty.

Benjamin, who has been in custody since April 11, must wait an addtional week behind bars to get a space on the most direct air route his home country.

"It would be unfair to fine him and have him incarcerated for 17 days,'' Mr.

White said. "He now wants to return to Nevis to rebuild his shattered life.'' He said Benjamin was a successful chef and a hardworking part-owner of a restaurant in the Boston area, and that these recent events will "cost him his life in the US''.

"He's committed no crime other than the charges before you,'' Mr. White told Senior Magistrate the Wor. Will Francis. "He's not a criminal from another jurisdiction. He came to Bermuda to spend his hard-earned dollars, which I'm sure we were happy to receive.'' Mr. Francis sentenced Benjamin to 10 days in prison with time already served taken into account, but remanded him in custody pending deportation.
