lawyers representing a Bailey's Bay couple charged with possessing and handling over $32,000 worth of cocaine with intent to supply.

The drugs were allegedly found under the front passenger seat of a car owned by Verna Lee Walker, 34, on December 28, 1992. She has pleaded not guilty to the charges along with Barry Stanley Wellman, 38.

Det. Con. Terence Gift, who was one of the officers at the scene when the drugs were allegedly found, said he was responsible for recording the events as they occurred.

Wellman's lawyer Mr. Richard Hector pointed out that the only place it was recorded that his client tried to walk away from the car, was in his statement dated February 15, 1993, and not in his notes. "Was that not significant?'' Mr. Hector asked.

Det. Con. Gift replied that many people walk away during searches because they are often not aware they have to stay and watch.

Mr. Hector then questioned Mr. Eugene Raynor who said he saw Wellman driving Walker's car near Shelly Bay around 12.50 a.m. on December 28. He said he noticed two other people in the car.

"The gentleman in the car was waving to me. He had a long sleeved, dark shirt on and he was driving the car. It was Barry Wellman.'' he said.

Raynor said after he made his statement to Police on December 30, he received a phone call on May 6 from Wellman. "He wanted to speak to me about dropping the statement I made to Police. He asked me to get the charges dropped because his lawyer thought it could be a trouble spot for him.'' But when questioned by Mr. Hector, Raynor admitted that he had contradicted evidence he gave to Police. In his Police statement he said he recognised Wellman's voice. However, in his testimony he denied this, saying he could never recognise Wellman by his voice alone.

The trial continues today.
