Licence cancelled
are really stretching me'' before he ordered that his driving licence be "cancelled''.
"Don't bother going down to TCD (Transport Control Department),'' Mr. King told Jevon Reid Daniels yesterday. "You can't drive or ride for three years.
"Then you'll have to go down there and go through the whole process of taking the test again to get a licence,'' he continued. "Join Project Ride if you have to.
"I can't overlook the seriousness of your second conviction for driving in a manner dangerous to the public and a conviction for impaired driving at the same time. You must be able to handle your liquor though, to give Police a chase and run from them like that.'' Mr. King added: "This means you'll have to start from scratch. The law says that a second offence for manner dangerous shall see a cancellation of the driver's licence.
"I'm compelled by law to say that it is not suspended but cancelled. Young man, you are really stretching me here. I'm going to put some pressure on you (with fines).'' Daniels pleaded guilty in September to riding without due care and attention on September 2 for which he was fined $600 which had not been paid by yesterday.
He will have to pay that fine before he is released from custody and another $400 by November 30 in overdue fines for an unknown offence.
Daniels pleaded guilty to riding in a manner dangerous and impaired riding.
Crown Counsel Graveney Bannister told the court that officers saw Daniels riding west on Middle Road near Port Royal School at 4.55 a.m. on September 17 .
The cycle did not have a licence plate on it and Daniels was riding without lights.
He failed to stop for Police and accelerated to speeds in excess of 80 kph.
Daniels ended up in a hedge at the corner of Spring Benny Road before running off onto Port Royal Golf Course.
He stumbled and was caught and told Police he had "only three beers and one vodka and orange''.
He told Mr. King: "It was just stupid of me, the way I acted that night.
Since then I quit drinking. It was very childish of me.
"It won't happen again. I'm deeply sorry for all these offences. I'm asking for a stiff fine and time to pay.'' For the manner dangerous offence, Daniels was fined $1,000 and given a nine month prison sentence which he suspended for two years.
His driver's licence was cancelled under section 36 (1) of the Road Traffic Act which provides for the mandatory loss of driving privileges for "at least'' three years, up to $2,000 in fines and/or an 18 month prison sentence.
Daniels also now has a concurrent one year driving ban and another $1,000 fine for impaired driving.
He will have to pay $250 a week beginning on December 8 to pay off the $2,000 in fines.
Relieved at not going to jail for up to a year for the two main charges but still not pleased at the potential of spending the next 120 days for defaulting on the $600 fine, Daniels was lead away by Police.
